These terms govern your use of the BYC website and, where you have been granted access, the BYC platform. By using either, you agree to them. If you do not agree, please do not use the website or the platform.

Where your organisation has a separate written agreement with BYC Software Pty Ltd, that agreement prevails over these terms to the extent of any inconsistency.

Platform access is granted to named users on behalf of an organisation. You are responsible for keeping your credentials confidential and for activity carried out under your account.

• Do not share your account or allow another person to use it.
• Notify us promptly if you believe your credentials have been compromised.
• We may suspend or withdraw access where these terms are breached, or where we reasonably suspect a security risk.

You may use the website and the platform only for lawful purposes connected with your organisation's program reporting obligations.

• Do not attempt to gain unauthorised access to any part of the service, or to another organisation's data.
• Do not interfere with, disrupt or place unreasonable load on the service.
• Do not copy, scrape or redistribute content or data except as permitted by your agreement with us.
• Do not upload material that is unlawful, malicious or infringes the rights of others.

Data your organisation submits to the platform remains your organisation's property. You grant us the rights needed to host, process and display that data in order to provide the service.

You are responsible for ensuring that data you submit is accurate and that you are entitled to provide it to us. Handling of personal information is described in our Privacy Policy.

Material on this website is unclassified. The platform is not approved for the storage or transmission of classified information unless expressly agreed in writing with BYC.

Each party must keep the other's confidential information secure and use it only for the purposes of the engagement.

The platform, this website, and all software, design, text and branding within them are owned by BYC Software Pty Ltd or its licensors. Nothing in these terms transfers that ownership to you.

You are granted a limited, non-exclusive, non-transferable right to use the service for the duration of your access.

We aim to keep the service available, but we do not guarantee uninterrupted access. The service may be unavailable during planned maintenance or for reasons outside our reasonable control. Where practicable we will give advance notice of planned downtime.

The website and platform may link to or rely on third-party services. We are not responsible for the content, availability or practices of those services, and a link does not imply endorsement.

Nothing in these terms excludes rights that cannot lawfully be excluded, including under the Australian Consumer Law.

Subject to that, and to the extent permitted by law, we are not liable for indirect or consequential loss, and our total liability arising from the service is limited as set out in your agreement with us.

We may update these terms from time to time. The current version is always available on this page, with the date it was last updated shown at the top. Continued use after a change takes effect indicates acceptance of the updated terms.

These terms are governed by the laws of New South Wales, Australia. The courts of that jurisdiction have non-exclusive jurisdiction over any dispute arising from them.
